What’s in these terms

These terms tell you the rules for using all services provided by Personal Privacy Solutions Ltd (“We” or “TapX” or “us” or “ours”), either hosted on any part of our website at https://tapx.link or services delivered by https://tapx.link/, including all sub-domains, or provided via the Tapx mobile App.

By using Tapx you accept these terms

By using Tapx, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use Tapx. We recommend that you print a copy of these terms for future reference.

These terms of use refer to the following additional terms, which also apply to your use of TapX: Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using TapX, you consent to such processing and you warrant that all data provided by you is accurate. Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of TapX. When using TapX, you must comply with this Acceptable Use Policy.

We use the YouTube API to embed YouTube videos on our websites. You can find the YouTube Terms of Service here and manage your relevant Google security settings here .

Changes to these terms

We amend these terms from time to time. Every time you wish to use Tapx, please check these terms to ensure you understand the terms that apply at that time.

We will try to give you reasonable notice of any major changes that affect you.

We may suspend, terminate or withdraw Tapx

Our sites are made available free of charge.

We do not guarantee that Tapx, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of Tapx for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

You are also responsible for ensuring that all persons who access Tapx through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

We may suspend or terminate your right to use our website and terminate these Terms immediately upon written notice to you for any breach of these Terms.

Minimum User Age

Our Platform is only intended for use by persons above the age of consent in their respective jurisdiction. Where there is a justifiable reason to use the Platform below the relevant age of consent, parental consent will be required for such use.

You must keep your account details safe

This section only applies to End Users (individuals or organisations who are seeking to create or have created accounts with Us ).

You will be asked to choose a username and password as part of our security procedures. You must treat that information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion, you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at support@tapx.link

Intellectual property rights

Your materials

You retain your intellectual property ownership rights over content you submit to us for publication on our website. We will never claim ownership of your content but we do require a license from you in order to use it.

When you use our website or its associated services to post, upload, share or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.

The license you grant us can be terminated at any time by deleting your content or account. However, to the extent that we (or our Partners) have used your content in connection with commercial or sponsored content, the license will continue until the relevant commercial or post has been discontinued by us.

You give us permission to use your username and other identifying information associated with your account in a manner that is consistent with your privacy preferences and our Privacy Policy.

Your usage of materials on Tapx

We are the owner or the licensee of all intellectual property rights in Tapx, and in the material published on it (except for End User’s contributions – intellectual property rights in those belonging to the End User). Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

We grant our End Users the permission to download their materials for personal, non-transitory use.

You must not use any part of the content on Tapx for commercial purposes without obtaining a license to do so from us or our licensors.

This license shall automatically terminate if you violate any of these restrictions or these Terms and may be terminated by Personal Privacy Solutions LTD at any time.

End User and Partner-Generated Content is not approved or monitored by us

We have enabled all End Users with the ability to create Data Channels, which represent an encrypted way of secure communication between End Users and Partners (pre-approved organisations, which have entered into separate Agreement with Tapx), when requested.

Tapx allows End Users and Partners to interact with each other by way of sending and receiving data via our Data channels. For avoidance of doubt, data can be any form of communication, transaction, etc. This information and these materials have not been verified or approved by us. The views expressed by other users on TapX do not represent our views or values.

Do not rely on information on this site

The information on Tapx is provided for general information only. It is not intended to amount to advice on which you should rely.

Although we make reasonable efforts to update the information on Tapx, we make no representations, warranties or guarantees, whether expressed or implied, that the content on TapX is accurate, complete or up to date.

We are not responsible for other people’s websites

Where Tapx contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources. This applies to all services provided by Tapx.

Liability

Our website and the materials on our website are provided on an ‘as is’ basis. To the extent permitted by law, Tapx makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Tapx or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Tapx or an authorised representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Interacting on Tapx


Whenever you make use of a feature that allows you to post content to Tapx, or interact with other users of Tapx, you must comply with the content standards set out in our Acceptable Use Policy.

You promise that any such contribution does comply with those standards, and you will be liable to us and compensate us for any loss we suffer if you break that promise.

Any content, aside from your personal identifiable information, you upload to Tapx will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you agree for us to use, store and copy that content and to distribute and make it available as we see fit in compliance with Privacy legislation.

We have the right to disclose your identity to any third party who is claiming that any interaction or content posted or uploaded by you to Tapx constitutes a violation of their intellectual property rights, or of their right to privacy.

We have the right to remove any posting you make on Tapx if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.

You must not introduce malware onto Tapx

You must not misuse Tapx by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to Tapx, the server on which TapX is stored or any server, computer or database connected to Tapx. You must not attack Tapx via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offense. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use Tapx will cease immediately.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

- modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
- remove any copyright or other proprietary notations from any materials and software on this website;
transfer the materials to another person or “mirror” the materials on any other server;
- knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service Tapx provides;
- use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
- use this website or its associated services in violation of any applicable laws or regulations;
- use this website in conjunction with sending unauthorised advertising or spam;
- harvest, collect or gather user data without the user’s consent; or
use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Rules about linking to Tapx


You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to Tapx in any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of Tapx other than the home page.

We reserve the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy.

Which country’s laws apply to any disputes?

If you are a resident of a territory outside the United Kingdom, nothing in these terms will prevent you being entitled to any mandatory consumer protections applicable in the country where you live.

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England will have exclusive jurisdiction.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England.
